§1. Definitions

  • Seller / Liftaya – the operator of the liftaya.com store (full registration details at the end).
  • Store – the online store at liftaya.com.
  • Customer – a person making purchases in the Store.
  • Consumer – a Customer who is a natural person purchasing for purposes outside their business activity.
  • Goods – products offered in the Store, including self-adhesive push-up inserts, adhesive bras (sticky bras), shaping underwear and clothing, and other products worn directly on the body, together with accessories.
  • Order – the Customer's declaration of intent to conclude a sales contract.

§3. Technical requirements

Using the Store requires a device with internet access, a current browser, and an active e-mail address.

§4. Placing an order

  1. The Customer selects Goods, adds them to the cart and completes the order form (details, delivery address).
  2. The order is placed by clicking the checkout button with an obligation to pay.
  3. After placing the order the Customer receives an e-mail confirmation, which constitutes conclusion of the sales contract.

§5. Prices and payment

  1. Prices in the Store are shown in Polish złoty (PLN) and include taxes.
  2. Available payment methods: payment card (Stripe), Przelewy24.
  3. The Customer is obliged to pay immediately after placing the order.

§6. Delivery

  1. Delivery is carried out within Poland via couriers: InPost, DPD, DHL.
  2. Delivery cost is shown in the cart before placing the order. Delivery is free for orders from 99.99 PLN.
  3. Orders are usually processed within 24 hours on business days; delivery time depends on the carrier.

§7. Right of withdrawal and hygiene exclusion

  1. As a rule, a Consumer has the right to withdraw from the contract within 14 days of receiving the Goods.
  2. Exclusion: the Goods offered in the Store (push-up inserts, adhesive bras, shaping underwear and clothing, and other products worn directly on the body) are hygiene products supplied in sealed protective packaging. In accordance with applicable EU consumer law (and Art. 38(5) of the Polish Consumer Rights Act of 30 May 2014), the right of withdrawal does NOT apply once the packaging has been opened (seal broken) after delivery, for reasons of health protection and hygiene.
  3. Withdrawal is possible only for Goods that are unopened, with an intact seal, complete and unused, after prior notice to [email protected].
  4. Every return is inspected. If the packaging is damaged, the seal is broken, or the product shows signs of use, the Seller may refuse the return and not refund the payment. The cost of returning the Goods is borne by the Consumer.
  5. The above does not limit the right to complain about defective/damaged Goods (§8).

§8. Complaints

  1. The Seller is liable for the conformity of the Goods with the contract under applicable consumer law.
  2. Complaints can be submitted by e-mail to [email protected], describing the defect and the request.
  3. The Seller handles complaints within 14 days.

§9. Personal data

Data processing is described in the Privacy Policy.

§10. Out-of-court dispute resolution

A Consumer may use out-of-court methods of handling complaints, including the European Commission's ODR platform: ec.europa.eu/consumers/odr.

§11. Final provisions

  1. Matters not regulated herein are governed by Polish law, in particular the Civil Code and the Consumer Rights Act.
  2. The Seller may amend these Terms for valid reasons; orders placed earlier are governed by the Terms in force at the time of ordering.
